- If you are denied benefits by your local Social Security Office, you have 60 days to file an appeal and request an evaluation by an Administrative Law Judge. The Administrative Law Judge evaluates your medical records and other evidence before issuing a Favorable or Unfavorable Decision.
- If the Administrative Law Judge issues an Unfavorable Decision, denying your Social Security Benefits, you have 60 days to request a review by the Social Security Administration's Appeal Council's review. The Council reviews all evidence provided to the Administrative Law Judge, as well as any written statements provided to them by you or your attorney.
- If the Council denies your Social Security Benefits, you have 60 days to file an appeal with the United States District Court of Appeals. The Federal Court reviews only the transcript from your Administrative Law Hearing and all evidence submitted, but the Federal District Court Judge(s) may present new evidence for consideration.
